Adopted to satisfy 2 CCR §20800.9 and §20801.3(b). This policy applies to every Red Tape Academy notary public education course of study.
Enrollment is not yet open. No Red Tape Academy course satisfies the notary public education requirement of Government Code section 8201 unless and until the Secretary of State issues a certificate of approval for that course of study. No fees are being collected at this time. This policy is published in advance so that it is available before any fee is ever charged.
Advance disclosure: §20800.9(a)
Prior to charging any fee to a notary public applicant or notary public for the approved course of study, Red Tape Academy discloses this refund policy to that person. Disclosure occurs by:
- displaying this policy in full on the course registration page, above the payment step, requiring affirmative acknowledgment before payment can be submitted; and
- including this policy in the registration confirmation sent to the student.
No fee is collected before this disclosure is made and acknowledged.
Mandatory refund conditions: §20800.9(b)
Red Tape Academy refunds all fees within thirty (30) business days of the scheduled course date to any registered person if either of the following occurs:
- an instructor fails to appear at the scheduled time, date, and place of the approved course of study; or
- the approved course of study is delayed in starting more than fifteen (15) minutes after the scheduled time, and the person immediately informs Red Tape Academy of their request for a refund, and the person leaves the course of study prior to it starting.
All three conditions in item 2 must be met. Students are informed of this at registration and again at check-in on any day the course start is delayed.
Online delivery equivalents
For online delivery, the following equivalents are stated for the avoidance of doubt:
- Where the course is not available to a student at the time the student attempts to begin it, because of an outage or fault in Red Tape Academy’s system, and the student requests a refund before completing any module, all fees are refunded within thirty (30) business days.
- Where an outage or fault in Red Tape Academy’s system prevents a student from continuing for more than fifteen minutes, and the student requests a refund at that time and does not resume, all fees are refunded within thirty (30) business days.
Additional voluntary refund terms
Red Tape Academy also refunds all fees, beyond what §20800.9 requires, if Red Tape Academy cancels a scheduled session for any reason. A student may alternatively elect to transfer to a later scheduled session at no charge.
Refund upon cancellation of the certificate of approval: §20801.3(b)
If Red Tape Academy cancels its certificate of approval, it will refund all fees to all persons who paid for a course scheduled after the effective date of cancellation, within thirty (30) business days of that effective date.
